Terms of Service

Please Read Carefully. These Terms of Service ("Terms") govern your access to and use of the Home Insight Pro platform operated by Vertex Infrastructure Holdings, LLC, doing business as Home Insight Pro ("Company," "we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By creating an account, clicking "I agree," or otherwise accessing or using the Service, you represent that:

  • You are at least 18 years of age.
  • You have the legal capacity to enter into a binding agreement.
  • You agree to comply with these Terms and our Privacy Policy.

If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

Home Insight Pro is a property intelligence platform that provides comprehensive home reports including structural details, roof data, HVAC systems, electrical specifications, flood zone status, and other property information. Reports are generated from a combination of:

  • Licensed contractor records submitted through our contractor network.
  • Public records and county assessor data.
  • AI-enhanced data extraction and estimation.
  • Homeowner-submitted and trade professional-submitted updates.

3. Account Registration

3.1 Account Types

We offer the following account types:

  • Consumer/Homeowner: For homeowners, home buyers, and individuals.
  • Realtor/Real Estate Agent: For licensed real estate professionals.
  • Trade Professional: For licensed contractors, electricians, plumbers, HVAC technicians, roofers, and other tradespeople who submit verified property data.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials. Passwords must meet our security requirements (minimum 12 characters with uppercase, lowercase, number, and special character). You agree to notify us immediately of any unauthorized use of your account.

3.3 Email Verification

Upon registration, you will receive a verification email at the address you provide. You must verify your email address to gain full access to the Service. Unverified accounts may have limited functionality.

3.4 Third-Party Authentication

You may choose to register or sign in using third-party authentication providers (e.g., Google, Apple). By doing so, you authorize us to access and use certain information from your third-party account as described in our Privacy Policy. You remain responsible for compliance with the third-party provider's terms of service.

3.5 Accurate Information

You agree to provide accurate, current, and complete information during registration and to update your information as necessary. We reserve the right to suspend or terminate accounts with false or misleading information.

4. Pricing and Payments

4.1 Pricing Plans

We offer the following plans:

  • Single Report: $2.99 one-time purchase for one property report.
  • 30-Report Bundle: $60.00 one-time purchase for 30 property reports.
  • Realtor Pro Monthly: $49.99/month subscription for unlimited property reports.

Prices are in U.S. dollars and are subject to change with 30 days' notice.

4.2 Payment Processing

All payments are processed securely through Stripe, Inc. By making a purchase, you agree to Stripe's terms of service. We never store your credit card information on our servers.

4.3 Free Home Report

Users who provide their home address during registration may access the report for their own property at no charge. This benefit is limited to one property per account and is subject to our address verification process.

4.4 Refund Policy

  • Unused credits: One-time purchases (Single Report and 30-Report Bundle) may be refunded within 14 days of purchase if no credits have been used.
  • Used credits: Credits that have been consumed to view property reports are non-refundable.
  • Subscriptions: You may cancel your Realtor Pro subscription at any time. Access continues until the end of your current billing period. No partial refunds are issued for unused portions of a billing period.

4.5 Refund Credit Requests

If a property report returns insufficient data, you may submit a refund credit request through the Service. Refund credit requests are reviewed by our administration team and approved or denied at our sole discretion. Approved requests result in one (1) search credit being returned to your account. Refund credits do not constitute a cash refund. Refund credit requests must be submitted within 7 days of the search.

4.6 Credit Expiration

Single report and bundle credits do not expire. Subscription access is active for the duration of the paid subscription period.

5. Acceptable Use

You agree not to:

  • Use automated scripts, bots, scrapers, or other automated means to access the Service.
  • Attempt to reverse-engineer, decompile, or extract source code from the Service.
  • Redistribute, resell, or sublicense property reports or data obtained from the Service without our prior written consent.
  • Submit false, misleading, or fraudulent property information.
  • Claim ownership of a property you do not own.
  • Use the Service, or any information obtained from the Service, for any unlawful purpose, including but not limited to discrimination on the basis of race, color, religion, sex, national origin, familial status, disability, sexual orientation, gender identity, or any other characteristic protected by federal, state, or local law.
  • Use the Service, or any data or reports from the Service, to make or influence decisions related to the eligibility of any individual for housing, credit, insurance, employment, or any other purpose governed by the Fair Housing Act (42 U.S.C. § 3601 et seq.), the Equal Credit Opportunity Act, or any similar federal, state, or local anti-discrimination law.
  • Use the Service to evaluate, screen, or profile current or prospective tenants, buyers, borrowers, or insurance applicants in a manner that would violate fair housing or fair lending laws.
  • Attempt to circumvent security measures, rate limits, or access controls.
  • Interfere with or disrupt the Service or its infrastructure.
  • Impersonate another person or entity.

5A. Fair Housing Act Compliance

Fair Housing Notice. Home Insight Pro is a property information tool. It is NOT designed, intended, or authorized for use in making housing, lending, insurance, or tenant-screening decisions about any person or protected class. Any such use is strictly prohibited and constitutes a material breach of these Terms.

Home Insight Pro provides information about properties — not about the people who live in, own, or are associated with those properties. The Service:

  • Does not collect, display, or infer any information about the race, color, religion, sex, national origin, familial status, disability, or any other protected characteristic of any individual.
  • Does not provide neighborhood "scores," demographic profiles, school ratings, crime statistics, or any proxy data that could be used to discriminate against protected classes.
  • Does not constitute a "consumer report" as defined by the Fair Credit Reporting Act (15 U.S.C. § 1681 et seq.) and is not intended for use as such.
  • Does not evaluate the creditworthiness, character, general reputation, or personal characteristics of any individual.

Users who are real estate agents, lenders, insurers, landlords, or property managers must comply with all applicable federal, state, and local fair housing laws in their use of the Service. Violations of this section will result in immediate account termination and may be reported to the U.S. Department of Housing and Urban Development (HUD) or applicable state authorities.

6. Data Accuracy and Disclaimers

IMPORTANT — READ CAREFULLY: Property reports generated by this Service are informational only and are provided on an "AS IS" basis. Reports may include data from AI-enhanced sources, public records, homeowner self-reports, and contractor submissions. We do not guarantee and make no representation or warranty that any information in a property report is accurate, complete, current, or error-free. Property reports are not a substitute for a professional home inspection, appraisal, survey, title search, or any other professional assessment. You should never rely solely on information from this Service when making any real estate, insurance, lending, or financial decision.

6.1 No Professional Advice

The Service does not constitute, and is not a substitute for, professional home inspection, appraisal, engineering assessment, legal advice, insurance underwriting, financial advice, or any other professional service. The Company is not a licensed home inspector, appraiser, engineer, attorney, insurance agent, or financial advisor. We strongly recommend consulting qualified, licensed professionals before making any property-related decisions. No information provided by the Service should be construed as professional advice.

6.2 Data Sources and Reliability

Each data point in a report is tagged with its source (e.g., "Contractor Verified," "AI Estimated," "Homeowner Reported"). Source labels are provided for transparency and to help you assess the relative reliability of each data point. However:

  • AI-estimated data is generated by artificial intelligence models that may produce inaccurate, incomplete, or outdated information. AI estimates are approximations only and should be independently verified.
  • Homeowner-reported data is self-reported and has not been independently verified by the Company. Homeowners may provide information in good faith that is nonetheless inaccurate.
  • Contractor-verified data reflects information submitted by trade professionals. While we verify contractor credentials, we do not independently verify every data point submitted.
  • Public records data is sourced from county assessor databases and other government sources, which may contain errors, be outdated, or reflect different measurement standards.
  • Contractor-verified roof data is sourced from our licensed contractor network and reflects information provided by roofing contractors at the time of installation. Conditions may have changed since installation.

6.3 No Warranty of Accuracy

THE COMPANY EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE ACCURACY, COMPLETENESS, RELIABILITY, OR TIMELINESS OF ANY DATA OR INFORMATION PROVIDED THROUGH THE SERVICE. YOU ACKNOWLEDGE AND AGREE THAT:

  • Property conditions may have changed since data was collected or estimated.
  • Square footage, lot size, and other measurements may differ from actual conditions.
  • System ages, conditions, and lifecycle estimates are approximations and do not predict actual remaining useful life.
  • Flood zone, environmental, and hazard information may be incomplete and should be verified with local authorities.
  • The absence of data in a report does not indicate the absence of a condition, feature, or hazard at the property.

6.4 Third-Party Data

We are not responsible for the accuracy of data obtained from third-party sources, including but not limited to county assessor databases, public records, AI models, search engines, and data aggregators. We do not control these sources and cannot verify every data point obtained from them. Any reliance on third-party data is at your sole risk.

6.5 User Responsibility

You are solely responsible for verifying any information obtained from the Service before relying on it for any purpose. Any decisions you make based on information from the Service are made at your own risk, and you agree that the Company shall have no liability for any loss or damage arising from your reliance on such information.

7. Intellectual Property

7.1 Our Property

The Service, including its design, code, text, graphics, logos, and compiled report formats, is the property of Vertex Infrastructure Holdings, LLC and is protected by U.S. and international intellectual property laws. The Home Insight Pro name and logo are trademarks of Vertex Infrastructure Holdings, LLC.

7.2 Your Content

By submitting property updates, photos, or other content to the Service, you grant us a non-exclusive, royalty-free, perpetual, worldwide license to use, display, modify, and distribute that content as part of the Service. You represent that you have the right to submit any content you provide.

7.3 Report Usage

Property reports you purchase are licensed for your personal or internal business use. You may share individual reports with clients, lenders, or insurers for the purpose of a specific real estate transaction, but may not systematically redistribute report data.

8. Trade Professional Accounts

Trade professionals who register agree to the following additional terms:

  • All submitted professional credentials (license number, trade type, state) must be accurate and current.
  • Property updates you submit will be reviewed for accuracy and may be marked as "pending verification" until your account is verified by our administrators.
  • Verified trade professionals' updates will be given higher data priority in property reports.
  • Submitting false or misleading property data may result in immediate account termination.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, AND RELIABILITY.
  • WE MAKE NO WARRANTY THAT ANY INFORMATION OR DATA PROVIDED THROUGH THE SERVICE IS ACCURATE, COMPLETE, CURRENT, OR RELIABLE. WE SPECIFICALLY DISCLAIM ANY WARRANTY THAT PROPERTY REPORTS WILL IDENTIFY ALL MATERIAL DEFECTS, HAZARDS, OR CONDITIONS OF A PROPERTY.
  • IN NO EVENT SHALL VERTEX INFRASTRUCTURE HOLDINGS, LLC, ITS PARENT COMPANIES, SUBSIDIARIES, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, DATA PROVIDERS, OR TECHNOLOGY PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES.
  • WITHOUT LIMITING THE FOREGOING, THE COMPANY SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM: (A) INACCURATE, INCOMPLETE, OR OUTDATED PROPERTY DATA; (B) YOUR RELIANCE ON INFORMATION IN PROPERTY REPORTS; (C) REAL ESTATE TRANSACTIONS, INSURANCE DECISIONS, LENDING DECISIONS, OR ANY OTHER DECISIONS MADE BASED ON INFORMATION FROM THE SERVICE; (D) FAILURE TO DISCLOSE A PROPERTY CONDITION THAT WAS NOT CONTAINED IN OUR DATA SOURCES; OR (E) AI-GENERATED ESTIMATES OR PREDICTIONS THAT PROVE TO BE INACCURATE.
  • OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY, AND YOU MAY HAVE ADDITIONAL RIGHTS.

10. Indemnification

You agree to indemnify, defend, and hold harmless Vertex Infrastructure Holdings, LLC and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit to the Service.

11. Termination

11.1 By You

You may delete your account at any time by contacting us at info@nrir.net. Upon deletion, your personal data will be removed in accordance with our Privacy Policy. Unused credits are non-transferable and non-refundable upon voluntary account deletion.

11.2 By Us

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or other conduct that we determine is harmful to the Service or other users. We will make reasonable efforts to notify you before termination, except where immediate action is necessary.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Oklahoma, without regard to its conflict of laws provisions. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Oklahoma County, Oklahoma, and you consent to the personal jurisdiction of such courts.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a prominent notice on the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.

14. Miscellaneous

  • Entire Agreement: These Terms, together with our Privacy Policy and Information Security Policy, constitute the entire agreement between you and Vertex Infrastructure Holdings, LLC regarding the Service.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
  • Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
  • Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights without restriction.
